Ansor Legal Aid Sues Sekda Tangsel's Inauguration at PTUN Serang, Mayor Benyamin Ready to Face Legal Process
Tangsellife.com - The Legal Aid Institute (LBH) Ansor South Tangerang City has officially sued the decision of the Mayor of South Tangerang regarding the inauguration of Bambang Noertjahjo as Regional Secretary (Sekda) to the State Administrative Court (PTUN) Serang.
The lawsuit was filed on Monday (07/06/2026) and is registered under case number SRG-060720262T4.
LBH Ansor Assesses Sekda Inauguration Allegedly Formally Flawed
The Legal Counsel Team of LBH Ansor South Tangerang City, Muhammad Khoerul Umam, stated that the lawsuit was filed after his party conducted a legal review of the Sekda Tangsel inauguration process.
According to him, the review found alleged violations of statutory provisions.
"We have reviewed the inauguration process. As a result, we found alleged formal flaws," said Khoerul, Tuesday (07/07/2026).
He assessed that the decision of the Mayor of South Tangerang regarding the inauguration of Bambang Noertjahjo was not based on applicable legal provisions.
"The decision of the Mayor of South Tangerang is not based on applicable laws and regulations," he said.
Claim to Have Exhausted Administrative Efforts
Khoerul explained that before filing the lawsuit with the PTUN, LBH Ansor had gone through the administrative mechanism by submitting an objection to the Mayor of South Tangerang.
However, according to him, the response received was from the Personnel and Human Resources Development Agency (BKPSDM) of South Tangerang City and was considered not to have answered the substance of the objection filed.
Subsequently, LBH Ansor filed an administrative appeal to the Governor of Banten.
"Until the lawsuit was filed, our administrative appeal had also not received a response. Therefore, we officially filed a lawsuit with the PTUN Serang," said Khoerul.
Request for Official Appointments Based on Merit System
LBH Ansor hopes that the lawsuit can serve as an evaluation material for the South Tangerang City Government in the process of appointing officials.
According to Khoerul, every official appointment should refer to applicable legal provisions and implement a merit system in the management of state civil apparatus.
"The inauguration of officials must be based on applicable regulations and prioritize the merit system," he said.
Mayor Benyamin Davnie Respects Legal Process
Responding to the lawsuit, the Mayor of South Tangerang, Benyamin Davnie, stated that he would follow all stages of the legal process that is underway at the PTUN Serang.
He chose to fully entrust the matter to the judicial mechanism and was reluctant to speculate on the outcome of the trial.
"I will just follow the legal procedure until it is legally binding," said Benyamin.
